Travis County Precinct 2 Constable Adan Ballesteros announced April 30 that he filed a lawsuit in the civil court of Travis County against his re-election opponent Michael Cargill. The lawsuit alleges that Cargill has made "false and inflammatory statements" about Ballesteros on Twitter, in flyers passed out in church parking lots, at candidate forums and at the Travis County Democratic Convention. Ballesteros is also seeking an injunction and a restraining order against Cargill.
According to the release, the flyers say Ballesteros was fired from the Department of Public Safety for allowing the transport of cocaine into the country. Ballesteros said he believes he was terminated for not firing a female employee who sued the department for sexual harassment.
The release also says that Cargill accuses Ballesteros of accepting cash gifts from a confidential informant, which Ballesteros says is also untrue.
Ballesteros has retained attorney Kevin Madison for representation.
Cargill was reached for comment, but he said he had no knowledge of the lawsuit.
In Northwest Austin, Precinct 2 encompasses much of the area north and some of the area south of the MoPac and US 183 intersection.
