No Refusal allows APD officers to electronically request a search warrant for a blood sample of anyone who refuses a breathalyzer or blood test and is suspected of driving while intoxicated.
The why
The announcement follows October 2023 data from Vision Zero—a city initiative to end traffic fatalities—that revealed drug and alcohol use is found in most pedestrian, passenger, driver, motorcyclist and micromobility fatalities. About 77% of fatal crash victims analyzed by the Travis County Medical Examiner’s Office between 2018-22 had either a blood alcohol content above 0.08 or positive results for a drug test.
