The city of Kyle will receive $135,000 for consulting costs related to the acquisition of property relating to the Limestone Creek Development.

The funds come after City Council approved a deposit agreement with Meritage Homes of Texas LLC at its regular meeting June 6.

The vote

The council voted 4-3 to approve the deposit agreement with Mayor Pro Tem Michael Tobias and Council Members Yvonne Flores-Cale and Daniela Parsley dissenting.

Kyle City Council approved the Limestone Creek Development agreement and established a tax increment reinvestment zone with Meritage Homes March 7.

Several homes within the Quail Ridge subdivision will be acquired to make way for a new road, called GoForth Road, which will be built within the development. The residents who will be displaced may be eligible for relocation assistance and benefits at the service of the two relocation experts, LJA Engineering and Stateside Right of Way Services, which will be provided by the city and paid for by Meritage Homes.

According to an email from Kyle Director of Communications Rachel Sonnier, introductory letters were mailed to affected residents May 5. The city also sent Spanish copies of the introductory letters and noncertified introductory letters in both English and Spanish on May 18.

Cost breakdown


Meritage Homes will pay $135,000 for fees the city incurs by Stateside Right of Way Services.
  • $131,480 for Stateside Right of Way Services' contract
  • $3,500 for property surveys
Leftover funds will be used as needed.

Going forward

According to agenda documents, the money will be deposited with the city 20 business days after the agreement is approved to cover consulting costs related to property acquisition, including relocation fees and eminent domain fees.

Once the funds are acquired, the city hopes to get the contract with Stateside Right of Way Services underway and make phone calls to set up the initial visits with the affected property owners.
