An ordinance to amend the city of Fair Oaks Ranch’s code of ordinances related to the Municipal Development District board of directors was indefinitely postponed during the April 3 City Council meeting.

The agenda item was postponed to give the board of directors time to review the proposed changes.

How we got here

Established in 2011, the MDD is a taxing entity focused on stimulating economic growth within the city.

According to the MDD rules of procedures, the board of directors consists of at least two members of City Council and one member of the Fair Oaks Ranch Homeowners Association, or FORHA.


Council approved the first reading of a resolution March 20, which would allow MDD directors to continue serving temporarily after leaving the FORHA or City Council.

During the meeting, Mayor Greg Maxton explained that the city elections are held in May, and the HOA terms end in the middle of the year. Since the MDD board is appointed in September of each year, there are gaps between changes in City Council and changes in the MDD board.

To provide clarity to the rules of procedures, the proposed resolution would have allowed former council members and FORHA members to serve on the MDD board until the next appointment cycle.

The City Council was scheduled to approve the second reading of the resolution May 3 but made the decision to postpone the discussion until the MDD board has enough time to review the rules of procedures before presenting a new resolution to City Council.

Council member Keith Rhoden–who also serves as an MDD director–made the motion to indefinitely postpone the resolution, allowing it to be brought back to City Council at any later meeting.

“I think it would be a good idea to put this on pause and let the MDD look at to see if there are any other suggestions they may have for council, so that we don’t piecemeal any changes,” Rhoden said.

The next MDD meeting is scheduled for April 9, where directors will discuss the proposed updates, according to the meeting agenda.
