Drivers and bicycle riders traveling through Bee Cave can now send a mobile text message while stopped at a red light or stop sign in city limits. It is an ordinance update reflecting a change in state law that took effect in September.
In 2015, Bee Cave City Council adopted a hands-free ordinance that prohibited motor vehicle operators and bicycle riders from holding electronic devices. That part of the ordinance remains in effect, said Police Chief Gary Miller though a clause forbidding a driver from texting is removed since the state law pre-empts that.
The city ordinance still prohibits the operator of a motor vehicle or a bicycle while on a private roadway where that authority has been extended— Hill Country Galleria, Shops Parkway, Uplands, etc.—from using a wireless communication device to engage in a phone call, according to city documents.
The ordinance does not apply to drivers calling Emergency 911 or someone using a GPS device affixed to their vehicle.
Miller told the council he believes existing signage about the ordinance should be sufficient.
The state texting or talking while driving offense is considered a misdemeanor and is subject to fines, city records show.
