Christopher Milam and the developers of mixed-use project The Backyard responded to a lawsuit filed by Outlier Energy July 20 that claims the developers defrauded Outlier, wrongfully terminated the energy company and knowingly gave away its trade secrets. The Answer, filed Aug. 18 in the 250th Judicial District of Travis County District Court, denied every allegation raised by Outlier in its lawsuit. Specifically, Milam and The Backyard developers' filed Answer to the Outlier lawsuit states:
  • Outlier waived, or relinquished, its right to file a lawsuit.
  • Outlier may have tried to enforce part of a contract that The Backyard developers and Outlier agreed not to enforce.
  • Outlier committed a wrongdoing and cannot justify suing The Backyard developers.
  • The Backyard developers communicated within their right to free speech.
  • Outlier does not have a claim or action for The Backyard developers revealing trade secrets of the energy company.
  • If Outlier was harmed by any actions by The Backyard developers, it had a chance to lower its damages but did not do so.
Additionally, The Backyard, by its filing, put the ball in Outlier’s court to provide further information by Sept. 18 to support the lawsuit filed by the energy provider.
