Apartment and mobile home tenants displaced by new development are now eligible for assistance from the city of Austin.
Austin City Council voted Thursday to approve a program to provide tenant notification and relocation assistance for certain development projects that displace apartment and mobile home dwellers.
A
front-page story in the Central Austin edition of
Community Impact Newspaper delved into the then-proposed ordinance in detail.
Here's what you need to know about the new ordinance:
1. The city's proposed fiscal year 2016-17 budget does not contain funds to support the
$1.6 million program.
2. Only people who live in multifamily buildings with
five or more residential units or mobile home parks are eligible.
3. It requires developers to provide notice to affected tenants
120 days prior to submitting an application for a building or demolition permit. Mobile home parks require
270 days.
4. To be eligible, tenants must have a household income at or below
70 percent of the median family income and
80 percent for mobile home park residents.
5. Developers have to pay a
tenant relocation fee if they are proposing to establish a planned unit development, or PUD, zoning district in place of the multifamily development or if they are requesting a rezoning or other land use approval.
6. Funds from tenant relocation fees would be deposited into the newly established
city of Austin Tenant Relocation Fund, which the city would administer to provide assistance to displaced tenants.
7. Developers violating the ordinance can receive a fine of
up to $500.
8. District 10 Council Member Sheri Gallo floated an amendment Thursday to require displaced tenants who receive assistance to be in good standing and compliant with their lease agreements. The amendment failed, but Gallo asked council members to consider refinements to the law down the road.
