At its April 8 meeting, Montgomery City Council unanimously approved a memorandum of understanding with BCS Capital Development for a mixed-use project on 32.72 acres that includes public infrastructure improvements.

The details

The MOU outlines a cost-sharing agreement for water and sewer infrastructure extensions, roadway connections and other improvements for a development near the intersection of Lone Star Parkway and Hwy. 105, near Home Depot, according to the agenda.

The improvements are estimated to cost up to $4.8 million, with City Council agreeing to reimburse the developer up to that amount through a combination that could include sales tax revenue, ad valorem taxes and potential grants.

According to the agenda, the project involves:
  • Water utility extensions from Lone Star Parkway to CB Stewart Drive to enhance flow and pressure in the area
  • Sewer improvements near Pump Station No. 12 to support future development phases
  • Roadway upgrades and potential landscaping enhancements
The city will not take ownership of the detention pond, City Engineer Chris Roznovsky said.

The agreement caps reimbursement at $4.8 million and limits it to actual infrastructure costs collected by the developer and the developer won’t get paid back additional funds other than what will be spent, Mayor Sara Countryman said.

City Council also discussed the need to rezone approximately 13-14.5 acres of the northern site from commercial to multifamily zoning in the future and also addressed landscaping commitments, citing it should improve quality of life, council member Cheryl Fox said.

“Landscaping should actually be landscaping,” Countryman said.
