Two-minute impact

The board of trustees hired legal counsel following an issue of water availability at the district's new Calfee Middle School between WISD, the city of Conroe and Montgomery County.

J. Randal Bays—with The Bays Firm based in Conroe—filed the district's original petition for a temporary restraining order, or TRO, against the city of Conroe on Aug. 6.

Conroe turned on the water to the school the morning of Aug. 7 before Judge Tracy A. Gilbert signed the TRO—which required water restoration to the school—at 9:44 a.m. Aug. 7, according to the court document. The TRO also prevents the city from “disconnecting, ending, stopping or otherwise turning off” the school’s water service.


A hearing regarding the TRO is scheduled for Aug. 21, according to court documents.

Meanwhile, the district launched a webpage Aug. 6 "in light of ongoing questions and community interest ... to provide access to documentation related to the water issue at our new middle school,” district officials said in an Aug. 6 news release.

How we got here

Water to the campus was shut off, with Conroe officials citing the lack of a required developer agreement, which is mandatory for new water service under the city's current development moratorium, as reported.


On Aug. 1, the WISD board rejected the draft development agreement and instead authorized WISD Superintendent Kimberley James to negotiate directly.
