Montgomery County Precinct 3 Commissioner James Noack’s request for a temporary restraining order against Democratic Party Chair Marc Meyer was heard Dec. 20 by visiting Senior District Court Judge John Delaney, according a news release from Noack's office.

Noack seeks to compel Meyer to reject Democrat Lore Breitmeyer Jones’ filing and remove her from the March Democratic primary election ballot, Community Impact Newspaper previously reported. Noack alleges that Jones submitted her candidate application to Meyer after the state's filing deadline.

"In denying the temporary restraining order, [Delaney] indicated that there was sufficient time to conduct a fact hearing and provide Noack relief in the form of a temporary and permanent injunction," the release stated. "He set a date for the parties to return to court on Friday, January 14."

Jones currently serves as deputy chair of the Montgomery County Democratic Party.

"In 2016, Commissioner Noack managed to run unopposed; however, in 2020 the good people of south Montgomery County will have a choice on the ballot in November," Jones said. "Personally, I look forward to a very spirited campaign based on who best reflects the priorities and values of the constituents of Commissioner Precinct 3."
