Local ordinances implemented to preserve visual character for residential and commercial buildings were voided by Gov. Greg Abbott’s signing of House Bill 2439 on June 14, local officials said.
Government entities cannot enforce building material standards stricter than those set by the national building code once the new law takes effect Sept. 1, according to a bill analysis by the House Research Organization.
For McKinney, HB 2439 nullifies the city’s architecture code, including a portion that requires nonresidential buildings to have at least 50% masonry.
Director of Planning Jennifer Arnold said the city is still figuring out how to administer changes and ensure the city’s code complies with HB 2439.
However, Arnold said historical or cultural designated areas, such as Historic Downtown McKinney, can still be regulated under the city’s code. This includes commercial and residential buildings.
