Hays CISD officials are making preliminary steps for the site of a future elementary school, set to be located in the Waterstone subdivision in Kyle.

HCISD officials entered a tri-party agreement with Lennar Homes, the developer of the Waterstone community, and Hays County following unanimous board approval at a May 19 meeting.

Lennar Homes, which has already purchased additional property for future development in Waterstone, will donate about 12 acres of land within the subdivision to HCISD as part of the agreement. The agreement also requires HCISD to pay up to $1.2 million for infrastructure costs such as roadwork and drainage, according to district documents.

HCISD, Lennar Homes and Hays County, have entered into the agreement before Lennar Homes has made the donation due to deadlines for the permitting process with the county, Chief Operations Officer Max Cleaver said. However, the agreement was made “in good faith” that the developer will donate the tract of land at a later date and HCISD will pay infrastructure contingent on the donation.


Cleaver said the land could be for Elementary School No. 19 or other elementaries needed in the future. HCISD will use 2023 bond interest earnings for payment, according to district documents.

HCISD trustees approved a development agreement with GBRK Edgewood LLC for a site donation for Elementary School No. 18 at an April board meeting.

GBRK Edgewood, the developer for a spot in northeast Buda on Satterwhite Road, will donate 11.32 acres of land to the district for ES No. 18. The district will pay over $1.4 million for infrastructure costs including wastewater, drainage and streetwork through bond earnings. The district and GBRK Edgewood are still working on finalizing the donation agreement, district staff said.

HCISD voters approved construction of ES No. 18 as part of the 2025 bond.
