During city meetings in July and August, Boerne residents have raised concerns about the Buc-ee’s development and the agreement that was approved in 2016.
What’s happening?
Earlier this year, Buc-ee’s purchased a tract of land from the Texas Department of Transportation, or TxDOT, next to the larger parcel the convenience chain owned.
Boerne Communications Director Chris Shadrock, in an email, said the 5.155-acre purchased parcel was zoned B-2, or highway commercial access, in June 2020 to correspond with the zoning of the neighboring Buc-ee’s property.
During the adoption of the Unified Development Code, or UDC, in 2021, the B-2 zoning was retired and no new zoning designation was assigned to the property, Shadrock said.
As a result, the city is legally required to give the property a comparable zoning classification to match the original zoning. Shadrock said it has been determined that the appropriate zoning under the UDC is C3, or community commercial. This zoning update is what will be considered by the Planning and Zoning Commission and City Council.

On Aug. 12, Boerne residents discussed the development agreement approved around 10 years ago being outdated compared to current city regulations and standards.
Shadrock explained that the project is governed by the the agreement, which is vested to the city development regulations in effect on Oct. 8, 2019, when the preliminary plat application was completed.“Any new applications, such as the new proposed parking area on the recently purchased TxDOT right-of-way acreage, would conform and follow current City regulations and standards,” Shadrock said in an email.
According to Shadrock, before beginning construction Buc-ee’s must complete the following final steps and documentation:
- Utility agreement
- Construction release permit for sewer line and roadway project
- Construction release permit for approved buildings
- Underground infrastructure plans (electric, sewer, water, drainage, etc.)
- Utility relocations
- Fiber and telecommunications line relocations
- Final platting
- Site development permit
