PREVIEW: Harris County commissioners to hold Ben Taub hearing, discuss potential criminal justice changes

Harris County Commissioners Court will review more than 450 agenda items March 19, including holding a public hearing on the proposed parkland acquisition for Ben Taub Hospital's expansion as well as potential changes to the county's criminal legal system.

The overview

Harris Health, the county's public healthcare provider, is planning a $410 million expansion of Ben Taub Hospital in the Texas Medical Center to address inpatient capacity limitations, Community Impact previously reported.

The project relies on the acquisition of 8.9 acres of Hermann Park located directly across from the hospital called the Warnecke Tract. Harris Health officials previously said the expansion is needed to maintain the hospital's designation as a Level I trauma-capable facility, per Community Impact reporting.

However, many community members have since spoken out against the parkland acquisition at several town halls, questioning Harris Health's compliance with Chapter 26 of the Texas Parks & Wildlife Code. The state code requires the hospital district to ensure there is no feasible alternative to the proposal and the project includes "reasonable planning to minimize harm to the land."

Harris County commissioners scheduled the March 19 hearing in late January in compliance with Chapter 26 of the code, according to agenda documents. Commissioners Court must greenlight the eminent domain process for Harris Health to move forward with the expansion.

Also on the agenda

Commissioners are also set to discuss potential operational and fiscal changes to county's legal system as a result of Senate Bill 9, a 2021 law that shifted bail-setting authority for certain violent offenses to elected judges.

The change has since added "operational strain" to the county's justice system departments, including the District Courts, District Clerk's Office, Public Defender's Office and Pretrial Services, according to agenda documents.

Commissioners Court included $1 million in the fiscal year 2025-26 budget in anticipation of SB 9 requirements, but the departments may need additional resources to avoid frequent overtime spending and staff reassignments, per the agenda item.

Additionally, commissioners will discuss the "future roadmap" for the Public Defender's Office and assigned counsel services as part of Harris County's plan to reduce racial, ethnic and economic disparities within the criminal legal system, the agenda shows.
