Hays County Emergency Service District No. 9 officials will host a new public hearing Aug. 25 to discuss their proposed tax rate, which would be higher than the current rate if approved.

ESD 9 commissioners are looking to approve a $0.06237 per $100 property valuation tax rate for fiscal year 2025-26.

The current FY 2024-25 total tax rate sits at $0.05044 per $100 valuation. Despite the tax rate increase, it falls below the rate required for a voter-approval election.

The public hearing comes following a delayed decision on the new tax rate, stemming from community pushback and noncompliance with public hearing notices.


ESD9 failed to publish the time of the public hearing on their public notice and noted the wrong tax code, as previously reported by Community Impact.

The noncompliance was brought to attention by union members in the Hays Emergency Medical Services Association, the labor union representing field staff from San Marcos Hays County EMS and the company ESD 9 is contracted with.

Union staff and community members voiced concern about the noncompliance, as well as opposition to the tax rate and how it may impact SMHCEMS services.

ESD 9 District Administrator David Smith said he and the commissioners are taking accountability for the error and want to ensure compliance with public notice requirements.


ESD 9 commissioners will reconvene Aug. 25 to discuss the tax rate and upcoming fiscal year budget.
