Mere days after community members sounded alarm bells about a new distribution center rising off of Hwy. 71, the city of Bee Cave has filed an injunction against the developers to halt construction.

What's happening?

The 269,959-square-foot logistics center, called West Austin Business Park, began construction back in December, according to a filing with the Texas Department for Licenses and Regulation.

Site plans for the project show three buildings, with over 80 truck docks, warehouse space and offices.

According to a statement from the city of Bee Cave, current officials were not notified of the industrial nature of the facility and believe it is inappropriate for its location near the Sweetwater neighborhood.

The city also cited resulting noise, traffic and pollution as possible concerns for the project.

The background

Per city documents, the site was first added into the city of Bee Cave's extrajudicial territory in 2015 as a part of a development agreement with WS-COS development partners, also referred to as Wheelock.

The agreement includes a master development plan, which set the land parcel for "commercial and office" use.

The city said the nature of the current project violates the 2015 agreement and "several regulations."

Further details of how construction was allowed to progress thus far could not be confirmed by the city due to pending litigation.

Wheelock, which sold the land in November, and current developers with Velocis are party to the injunction filing.

Both companies did not immediately respond to a request for comment.

What's next

In the coming days, Travis County judges will decide whether to grant the injunction by determining what jurisdiction the city has over the property.

One other detail

Real estate brokers with KBC Advisors said none of the property had been leased yet, as of Aug. 12.
