A man accused of shooting and killing two people and injuring a third person at a Hollywood Park restaurant on Sept. 11 was caught by law enforcement officers outside of San Antonio and taken into custody, according to the Hollywood Park Police Department.

Darrick Oliver Jr., 22, was apprehended by Hollywood Park police detectives and Texas Rangers on Sept. 13 in Waco, Texas, according to information provided by the HPPD.

Police Chief Shad Prichard said on Sept. 14 that Oliver was charged with capital murder of multiple persons, and his bond was set at $1 million.

HPPD representatives said local police were dispatched to a shooting incident at Rose Bistro at 1:11 a.m. Sept. 11.

Hollywood Park police said, upon arrival, they discovered three people with gunshot wounds. One man, identified as Justin Hutchieson, was found with a gunshot wound to his face and declared deceased on the scene, police said.



A woman identified as Alaina Henderson was found alive but with a gunshot wound. She was taken to North Central Baptist Hospital, where she was declared deceased, police said.

A second man, identified as Franklin Peden III, was found injured at the scene and transported to University Hospital where he was said to be in stable condition, police said.

According to a media release, HPPD detectives and Texas Rangers collected video evidence at the restaurant and determined that an argument erupted between the two men and the alleged shooter.

The HPPD release said the dispute escalated when Oliver drew a handgun and fired at the two men several times at close range and then fled.


HPPD officials said the entire incident happened inside the restaurant in view of other customers at the time.

“The initial review appears to indicate [Henderson] was not an intended target but a bystander caught by a missed shot, causing her death,” the media release said.

Hollywood Park police said they and Texas Rangers were tipped off to the suspect’s possible hiding place—a family member’s home in Waco—and found him there Sept. 13.

“The suspect’s mother, along with detectives from Hollywood Park, was able to talk the suspect out of the home, and he surrendered peacefully after several hours of negotiations,” HPPD officials said in a Sept. 14 press release.


HPPD officials added that, following Oliver’s arrest, Prichard notified the families of the shooting victims.
